You may have the opportunity to submit content through our Services, such as quiz responses, comments, or feedback ("User Content"). By submitting User Content, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with our Services

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANKIVY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless RankIvy and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination:

• Your right to use the Services will immediately cease
• You must cease all use of the Services
• Provisions that by their nature should survive termination will remain in effect

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

• Entire Agreement: These Terms constitute the entire agreement between you and RankIvy regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
